Personal Best Pace is designed to help you track and celebrate your fitness achievements. These terms are straightforward: use our service responsibly, respect others, and we’ll provide you with a reliable platform for tracking your personal bests.

Acceptance of Terms

By accessing or using Personal Best Pace (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

Description of Service

Personal Best Pace provides a platform for tracking personal bests in running, cycling, and swimming activities by integrating with fitness tracking services including Strava and Garmin. Our Service includes:

  • Activity data synchronization from connected fitness platforms
  • Personal best tracking across multiple time periods (all-time, 12-month, 6-month, 3-month)
  • Email notifications for new personal bests
  • Optional activity post enhancements on Strava and Garmin
  • Performance analytics and trend visualization

Account Registration

To use our Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information
  • Accept responsibility for all activities under your account

You may not create an account using false information or on behalf of someone else without permission.

Third-Party Integrations

Strava and Garmin Connections

When you connect your Strava or Garmin account:

  • You authorize us to access your activity data as permitted by their respective APIs
  • You grant us permission to read your activities and related fitness data
  • You may optionally grant permission for us to enhance your activity posts
  • You can revoke access at any time through your Strava/Garmin settings

Your use of Strava and Garmin services remains subject to their respective terms of service and privacy policies. We are not responsible for changes to their APIs or services that may affect our Service.

Acceptable Use

You agree to use Personal Best Pace only for lawful purposes. You may not:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to our systems or other users’ accounts
  • Upload malicious code, viruses, or harmful content
  • Use automated systems to scrape or collect data from our Service
  • Reverse engineer or attempt to extract source code from our Service
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service or servers

User Content and Data

Your Data Ownership

You retain all rights to your fitness data and personal information. By using our Service, you grant us a limited license to:

  • Process and analyze your activity data to provide the Service
  • Display your personal bests and achievements to you
  • Store your data securely on our servers
  • Use anonymized, aggregated data for service improvement

Data Accuracy

Personal Best Pace calculates personal bests based on data provided by connected services. While we strive for accuracy, we cannot guarantee that all calculations are error-free. You are responsible for verifying the accuracy of your personal bests.

Service Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Emergency repairs
  • Third-party service outages (Strava, Garmin)
  • Internet or network issues
  • Force majeure events

We will make reasonable efforts to notify users of planned maintenance in advance.

Fees and Payment

Personal Best Pace currently offers free access to its core features. We reserve the right to:

  • Introduce premium features or subscription plans in the future
  • Modify pricing with reasonable notice to existing users
  • Offer promotional pricing or trials

Any future paid features will be clearly communicated, and you will have the option to accept or decline before being charged.

Termination

Your Right to Terminate

You may delete your account at any time through your account settings. Upon deletion:

  • Your personal data will be permanently deleted within 30 days
  • Connected service integrations will be disconnected
  • You will no longer receive notifications or service updates

Our Right to Terminate

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms of Service
  • Engage in fraudulent or illegal activities
  • Abuse the Service or interfere with other users
  • Provide false information during registration

We will make reasonable efforts to notify you before termination unless immediate action is required for security or legal reasons.

Disclaimers and Limitations of Liability

Service “As Is”

Personal Best Pace is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected
  • The Service is free from viruses or harmful components
  • Results obtained from the Service will be accurate or reliable

Limitation of Liability

To the maximum extent permitted by law, Personal Best Pace shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or use
  • Service interruptions or data loss
  • Third-party service failures (Strava, Garmin)

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

Intellectual Property

The Personal Best Pace name, logo, and all related designs, text, graphics, and other content are the intellectual property of Personal Best Pace and are protected by copyright and trademark laws. You may not:

  • Use our trademarks without written permission
  • Copy, modify, or distribute our software or content
  • Create derivative works based on our Service

Changes to Terms

We may modify these Terms at any time. When we make changes:

  • We will update the “Last Updated” date at the top of this page
  • For material changes, we will notify you via email or Service notification
  • Your continued use of the Service after changes constitutes acceptance

If you do not agree to modified Terms, you should discontinue use of the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
